Success before the Austrian Supreme Court regarding a liberalization levy charged to energy consumers (“Stranded Costs”)
   
 

Together with the first step of the liberalization of the Austrian electricity market in 1999, a special levy had been introduced to compensate certain power generators for revenue decreases resulting from the liberalization, amounting to a total of EUR 132 Mio. These contributions were not only charged to the largest industrial consumers that were able to change their supplier in the first step of the liberalization, but also to the other industrial and household consumers that were not yet liberalized. We represented several enterprises that reclaimed this levy from their system operators. In 2009, after time-consuming proceedings, we finally succeeded before the Austrian Supreme Court. The levy was then repaid to these enterprises.
